These Terms of Use (the “Terms”) govern your access to and use of southernvalleyhomes.com (the “Site”), operated by Southern Valley Homes(“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Use of the Site

The Site is provided for your personal, non-commercial use to learn about our floor plans, pricing approach, service area, and team — and to contact us about a potential build. You agree to use the Site lawfully and not to interfere with its operation, attempt to gain unauthorized access to any part of it, or use it to transmit harmful code or content.

Information is informational only

Floor plans, photos, pricing references, inclusion lists, and any other content on the Site are provided for informational purposes only. They do not constitute an offer, a quote, or a binding contract. Pricing varies by site, lot conditions, selections, and market conditions. A binding price exists only when reflected in a signed written agreement between you and Southern Valley Homes.

Photographs of homes we have built may include homeowner-elected upgrades or modifications that are not part of our standard inclusions. The standard inclusions for any plan are described in our written specification, which we walk through with every customer.

Form submissions

When you submit a form on the Site, you represent that the information you provide is accurate and that you are authorized to share it. We treat form submissions as described in our Privacy Policy. Submitting a form does not create a contract or obligate either party to enter into one.

Intellectual property

All content on the Site — including text, photographs, logos, floor plans, renderings, designs, and the overall look and feel — is the property of Southern Valley Homes or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may view and share Site pages for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, publish, or create derivative works from any Site content without our prior written permission.

The Southern Valley Homes name and logo are trademarks of Southern Valley Homes. Any other trademarks or service marks appearing on the Site are the property of their respective owners.

Third-party links

The Site may contain links to third-party websites (such as floor-plan tools, social networks, or partner services). We do not control these websites and are not responsible for their content, accuracy, or privacy practices. Linking to a third-party site does not imply our endorsement of it.

Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Statements about our process, inclusions, timelines, or pricing approach reflect how we typically operate; the binding terms of any specific build are those in your signed written agreement.

Limitation of liability

To the fullest extent permitted by law, Southern Valley Homes and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of the Site will not exceed one hundred U.S. dollars (USD $100) or the amount you paid us in connection with the Site, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full. Nothing in these Terms limits any liability that cannot lawfully be limited.

Indemnification

You agree to indemnify and hold Southern Valley Homesand its owners, employees, and contractors harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your misuse of the Site or your violation of these Terms.

Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Site or these Terms will be resolved exclusively in the state or federal courts located in Hernando County, Florida, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Site after a change means you accept the revised Terms.
